Release of Liability, Assumption of Risk, and Media Consent


Terms & Conditions: Ticket Purchase and Event Attendance

By purchasing a ticket, registering for, or attending Wine About Cancer (the "Event"), you acknowledge and agree to the following terms on behalf of yourself and any guests for whom you obtain tickets (collectively referred to as "Holder"):

1. Ticketing & Refund Policy

All ticket sales are final. No refunds, exchanges, or re-admission will be permitted. However, tickets are fully transferable to other guests (aged 21+). In the event of a cancellation beyond our control, your ticket purchase will be treated as a 100% tax-deductible donation to The Today Foundation.

2. Alcohol & Eligibility ("Safety First" Policy)

Holder certifies that they—and any guests for whom they have purchased a ticket—are at least 21 years of age and will have a valid government-issued ID present for entry. Holder agrees to consume alcohol responsibly and acknowledges that The Today Foundation, its board, staff, volunteers, vendors, sponsors, and associated parties (collectively, the "Released Parties") are not responsible for Holder’s consumption or actions following the Event. Holder agrees to arrange for safe transportation to and from the Event (e.g., a designated driver, ride-share, or taxi).

3. Assumption of Risk

Holder understands that attending a public event involves certain inherent risks, including but not limited to slips, falls, illness, or property damage. Holder and their guests must comply with all Event and venue policies and voluntarily assume all risks associated with participation in the Event, including travel to and from the venue.

4. Release of Liability

Holder hereby releases, waives, and forever discharges The Today FoundationWine About Cancer, the venue owners, and all event sponsors and vendors from any and all claims, liabilities, or demands for personal injury, property damage, or wrongful death that may occur during the Event or while traveling to or from the Event, whether caused by negligence or otherwise.

5. Indemnification & Covenant Not to Sue

Holder agrees to indemnify and hold harmless the Released Parties from any loss, liability, or cost they may incur due to Holder’s presence at the Event or any actions taken by Holder that cause harm to others or the venue. Holder waives all claims and covenants not to sue The Today FoundationWine About Cancer, or their designees, facility owners, sponsors, and respective affiliated entities, officers, directors, contractors, and employees for any liability arising from or in connection with the Holder’s attendance at the Event.

6. Media & Photo Release

I understand that photographers and videographers will be documenting the Event. By attending, I grant The Today Foundation the irrevocable right to use my image, likeness, and voice in promotional materials, social media, and future marketing efforts without compensation for the purpose of furthering the mission of The Today Foundation and growing the Event.
